General terms and conditions for using the DriversLOG mobile app and iziFLEET Web Platform from INFORMAP TECHNOLOGY CENTER LLC, located in Office HC2, Tiger 1, Sharjah, UAE.

PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE USING THE DRIVERSLOG MOBILE APP AND IZIFLEET WEB PLATFORM. BY USING THIS APP AND WEB PLATFORM, YOU ACCEPT YOUR AGREEMENT TO THESE TERMS & CONDITIONS. IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS BELOW, DO NOT ACCESS IZIFLEET WEB PLATFORM OR USE DRIVERSLOG MOBILE APP. INFORMAP RESERVES THE RIGHT TO MODIFY, ALTER, OR OTHERWISE UPDATE THESE TERMS & CONDITIONS FROM TIME TO TIME AS IT DEEMS FIT, WHICH MODIFICATIONS, ALTERATIONS, OR UPDATES SHALL AUTOMATICALLY BE BINDING ON YOU.

1. INTRODUCTION:

A. These terms and conditions apply to any "customer" who may be individuals or authorized users in a registered business establishment.

B. In relation to the provision of Services, the Customer shall observe and be bound by the terms and conditions specified in this document.

C. Customers shall be deemed to have accepted and agreed to be bound by these Terms and Conditions immediately upon clicking and using this mobile app or logging in to iziFleet web platform.

2. DISCLAIMER:

While INFORMAP uses reasonable efforts to include accurate and up-to-date information on this mobile app, INFORMAP makes no warranties or representations as to its accuracy. DriversLOG Mobile app Service and www.izifleet.com service are provided "as is" without any warranties or representations of any kind, whether express or implied, arising by law or otherwise, including without limitation any implied warranty of merchantability or fitness for a particular purpose or non-infringement or any implied warranty arising out of the course of performance, course of dealing, or its usage.

3. LIABILITY:

A. Notwithstanding anything to the contrary in these Terms and Conditions, INFORMAP shall have no liability for any direct, incidental, special, or consequential damages or any loss of revenue or profits arising under or with respect to DriversLOG Mobile app and iziFleet Online Service usage, even if INFORMAP has been advised of the possibility of such loss. If a Customer/User is not satisfied with any portion of DriversLOG Mobile app or iziFleet Web Platform or any of these Terms & Conditions, the Customer/User's sole and exclusive remedy is to discontinue using DriversLOG Mobile app and iziFleet Web Platform and seek reimbursement for the remaining part of the subscription period fee paid.

B. In particular, INFORMAP shall not be liable to any Customer for any downtime that it cannot control, for loss or damages, and/or any loss of data however caused, including without limitation, non-delivery, misuse or mis-delivery, or of any interruption, suspension, or termination of service, or for the contents, accuracy or information or resource made available or received or transmitted through DriversLOG app or iziFleet Web Platform.

4. LINKS TO OTHER MOBILE APPS:

INFORMAP is not responsible for any linked sites/mobile apps posted in DriversLOG mobile app or iziFleet Web Platform. The linked sites/mobile apps are for Customer convenience only. Customer/User understands and acknowledges that any access to such sites is at Customer/User's own risk. INFORMAP does not control such sites or the information contained therein. INFORMAP is not liable for any loss or damage that the Customer may sustain as a result of accessing such sites/mobile apps through DriversLOG mobile app or iziFleet Web Platform. The inclusion of links to other sites/mobile apps does not imply endorsement or sponsorship by INFORMAP of the linked sites/mobile apps or the information, products, or services contained therein.

5. PAYMENT RULES:

A. The Customer will pay the service charges as set forth on INFORMAP's pricing page or as otherwise agreed in writing.

B. The Customer will provide valid, up-to-date, and complete billing and contact information. The Customer shall promptly update such information with any changes.

C. INFORMAP will issue invoices for the Services and will specify the amount payable and the due date for payment.

6. MODIFICATION OF SERVICES:

A. INFORMAP reserves the right to add, modify, or remove features and functionalities of the Services at any time and for any reason.

B. INFORMAP reserves the right to modify or terminate the Services (or any part thereof) at any time, temporarily or permanently, without prior notice to the Customer.

C. INFORMAP shall not be liable to the Customer or to any third party for any modification, suspension, or discontinuance of the Services.

7. INTELLECTUAL PROPERTY:

A. The DriversLOG mobile app and iziFleet Web Platform, including all content, features, and functionality, are owned by INFORMAP or its licensors and are protected by intellectual property laws.

B. The Customer acknowledges and agrees that the DriversLOG mobile app and iziFleet Web Platform contain proprietary and confidential information that is protected by intellectual property rights.

C. The Customer shall not modify, reproduce, distribute, create derivative works of, publicly display or perform, republish, download, store, or transmit any of the material on the DriversLOG mobile app or iziFleet Web Platform, except as expressly permitted by these Terms and Conditions.

D. The customer or user vehicle information shall be shared for a limited time to registered suppliers for the purpose of making a quote or enter the data on behalf of the customer.

8. CHANGE OF ADDRESS

Subject to INFORMAP Applicable Terms & Conditions, Customers may change their password through mobile app or izifleet.com at any time. However, the loss or delay of any SMS code/ mail/ correspondence which might occur shall be at the sole risk and responsibility of the Customer.

9. AMENDMENTS

INFORMAP reserves the right to change, amend or reproduce these Terms and Conditions or any document related to DriversLOG Mobile App and iziFleet Web Services from time to time as it may deem fit. Any such change, amendment or reproduction shall immediately bind the Customer from the date on which it is posted on DriversLOG Mobile App.

10. CUSTOMER'S RESPONSIBILITIES

A. Subject to Applicable Terms and Conditions, Customer shall protect the secrecy of the password assigned to him/her at all times and shall ensure that the same is not revealed or disclosed in any manner whatsoever to any person or persons whomsoever. Customer shall be fully and solely responsible for and shall bear all charges, losses, and damages arising from any use of his or her / user identification and/or password, howsoever arises.

B. Customer shall at all times use only his own ID password for accessing DriversLOG Mobile App and iziFleet Web Platform. The Customer may change his/her password from time to time to ensure security.

c1. not carry out or allow any intellectual property right(s) infringement(s)
c2. not to use APP and Web online Services Customer's access for any illegal, improper, obscene or defamatory purpose or any purpose which is prohibited by law or these Terms and Conditions
c3. not to publish, post, upload, distribute or disseminate any inappropriate, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information in the ratings or comments or post any material harmful to INFORMAP business in any social media sites.
c4. not to upload materials, information or files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of user's computer or mobile devices or Informap servers.
C5. not to use the app and web Services in any manner which could damage, disable, overburden, or impair the Service or the network(s) connected to any Services or interfere with any other party's use of the Services;
C6. not to attempt to gain unauthorized access to DriversLOG Mobile App or iziFleet Web Platform online Services, other customer/user accounts, computer systems or networks connected to any DriversLOG Mobile App or iziFleet Web Platform through hacking or any other means;

11. CONTROL OF ACCESS TO DATA

INFORMAP reserves the right to manage and control the access to computer systems and data stored in DriversLOG mobile app and iziFleet Web Platform.

12. ACCESS SPEED

INFORMAP does not guarantee any specific response time for the DriversLOG mobile app or iziFleet Web Platform.

13. PRIVACY POLICY

INFORMAP is concerned about the privacy of the Customers and Users of DriversLOG Mobile app and iziFleet Web Platform. Informap shall not share the customer data with anyone, other than the suppliers or service providers base on as need basis in order to supply products and services to the customer. If customer does not the data to be shared, the customer shall not seek any supplier for sourcing its products or services.

14. DATA COLLECTION & PROTECTION POLICY

The collection, storage, use, retention, disclosure, transfer, security and access of Personal and vehicle Data will be in accordance with DriversLOG Mobile app usage and in accordance to the applicable laws in the United Arab Emirates.

COLLECTION OF PERSONAL / VEHICLE DATA

It may be necessary for the Customer to provide INFORMAP with her / his personal information ("Personal Data") and the vehicle data when vehicles are added. when Customer registers on the DriversLOG APP and/or continue to subscribe with the Services. If Customer Personal or vehicle Data is incomplete or incorrect, INFORMAP may not be able to provide or continue to provide its Services to Customer.

Customer agrees that the vehicle Data entered in the DriversLOG mobile app and infofleet.com may be used and retained by INFORMAP and INFORMAP may disclose and transfer to INFORMAP partners when customer opts to use partner services such as requesting for a quote for any of the products or services or when the vehicle is repaired/serviced from INFORMAP partner for the purpose of data entry on behalf of the customer. This will be only as need basis and only for the customers particular vehicle.

15. ACCOUNT DELETION

You have the option to delete your account on the mobile app. By deleting your account, all associated data and information will be permanently removed. Please carefully read and understand the following steps for the account deletion process:

1. To initiate the account deletion process, open the mobile app and log in to your account.
2. Navigate to the account settings or profile section of the app.
3. Look for the "Delete Account" or similar option and tap on it.
4. You will be prompted with a confirmation message to ensure you want to proceed with the account deletion.
5. Confirm your decision to delete your account.

Once your account is deleted, the following data will be permanently removed:

  • Personal information (name, email, etc.)
  • User-generated content (posts, comments, etc.)
  • App usage history
  • Any other data associated with your account
  • Please note that once your account is deleted, this action cannot be undone, and your data cannot be recovered. If you change your mind or have any concerns, please contact our support team for assistance.

    By using the mobile app and agreeing to these terms and conditions, you acknowledge and understand the implications of deleting your account. It is your responsibility to ensure you have backed up any necessary data before proceeding with the account deletion.     16. INTELLECTUAL PROPERTY, COPYRIGHTS AND TRADEMARKS

    A. The content of DriversLOG Mobile app and iziFleet Web Platform is protected by copyright, trademark and other intellectual property rights as applicable.

    B. Content including, but not limited to, design, screens, software, images and icons contained on or available through the DriversLOG Mobile app and infofleet.com is provided by INFORMAP. The intellectual property rights to and the contents contained in DriversLOG Mobile app and iziFleet Web Platform belong to INFORMAP. All rights are reserved. The contents of the APP or web portal cannot be copied, reproduced, modified, transferred, distributed, republished, downloaded, hacked, posted or transmitted in any form or by any means including but not limited to electronic, printing or recording without the prior written permission of INFORMAP. Customer/User agrees the material and content referred to above is for own personal or business establishment use.

    17. GOVERNING LAW & JURISDICTION

    This terms and conditions are governed by the laws of the United Arab Emirates. Any disputes arising out of or in connection with this terms and conditions shall be resolved in Dubai Courts.
